TxVia, Inc., a Delaware Corporation, and its partners and service providers (referred to collectively herein as the "Company") provides a message service called Prepaid Card Alerts (the "Service"), whereby registered cardholders ("You" or "Your") can request and receive information related to your Prepaid Card Account via SMS and/or email messages ("Alerts"). Your use of the Service is governed by these Terms and Conditions. These Terms and Conditions constitute a binding agreement between you and the Company. By clicking the "I Agree" button, or by using the Service, you expressly agree to be bound by these Terms and Conditions. These Terms and Conditions, which are in addition to any terms and conditions set forth in your Cardholder Agreement for your Prepaid Card Account, shall be in effect so long as you use the Service.
Service Overview and Authorization. You must register for the Service in order to receive Alerts. By registering for the Service and providing your mobile phone number, you expressly provide your authorization to receive Alerts, and you certify that: (a) you are the mobile phone accountholder or (b) you have the accountholder's permission to sign up for Alerts. In addition, as a part of the Service, you agree to receive all legally required notifications via electronic means. Alerts are available to you at no cost from the Company, but standard message charges apply; Other charges may apply. SMS Alerts are not compatible with all mobile phone handsets. Your mobile phone must be SMS enabled. Check with your service provider for details. Once you register for the Service, Alerts will continue until canceled by you. Message frequency depends on your card account settings, which you may access, view and change at the Company's website: www.univisiontarjeta.com. You can opt out of the SMS Text Message Service at any time by sending STOP to short code 346376, or by replying STOP to any of our SMS Text messages. Send HELP to short code 346376 for information, or call 1-877-883-6688. Participating mobile phone providers are: AT&T/Cingular, Sprint, Nextel/Boost, Verizon Wireless, T-Mobile USA, Cincinnati Bell, Alltel, Virgin Mobile USA, US Cellular, Metro PCS, RCC, Centennial, Cellsouth, Suncom and nTelos.
Opt in/Opt out/Help. As noted above, you must register for the Service in order to receive Alerts. The registration process is also referred to as "opt-in." All Opt-in registrations for the Service must be via our website at www.univisiontarjeta.com. During the registration process, you must read and accept these Terms and Conditions in order to opt into the Service. During the registration process, you must also select the type of automatic Alerts you would like to receive, if any. YOU MAY OPT OUT OF THE SMS TEXT MESSAGE SERVICE AT ANY TIME BY TEXTING "STOP" TO SHORT CODE 346376. THIS WILL IMMEDIATELY UNSUBSCRIBE YOU FROM THE SMS TEXT MESSAGE SERVICE AND YOU WILL NO LONGER RECEIVE TEXT MESSAGE ALERTS UNLESS YOU OPT IN AGAIN VIA THE WEBSITE AT www.univisiontarjeta.com. TO RECEIVE HELP AND INFORMATION ABOUT THE SERVICE, TEXT "HELP" TO SHORT CODE 346376, OR CALL 1-877-883-6688 DURING BUSINESS HOURS.
Fees. There are no fees assessed by the Company to you for use of the Service. HOWEVER, STANDARD TEXT MESSAGING OR SMS CHARGES MAY APPLY. OTHER CHARGES MAY APPLY. CHECK YOUR WIRELESS PROVIDER PLAN FOR DETAILS. YOU ARE RESPONSIBLE FOR THESE CHARGES TO YOUR WIRELESS PROVIDER. The Company reserves the rights to change its policies with respect to fees at any time with 30 day's prior notification to you.
Message Frequency. Alerts will be delivered to you by the Service at a frequency that you specify. For example, you may elect to receive one Alert for every specified transaction taking place against your prepaid Card Account, a daily Available Balance Summary, a weekly Available Balance Summary, or some combination of all three frequencies. At any time, you can halt transmission of Alerts by the Service according to the opt-out procedure described above. Otherwise, Alerts will continue until your Card Account is closed.
Your Access and Use of the Service. Your access and use of the Service may be interrupted from time to time for any of several reasons, including, without limitation, the malfunction of equipment, periodic updating, maintenance or repair of servers or other actions that the Company, in its sole discretion, may elect to take. The Company reserves the right to suspend or discontinue the availability of the Service and/or any portion or feature of the Service at any time in its sole discretion and without prior notice. The Company is not liable for any message deleted or not delivered, regardless of the reason for deletion or non-delivery, including without limitation message processing or transmission errors.
Acceptable Use. You agree with the following restrictions on use, which shall be referred to herein as the Acceptable Use Policy:
You agree that the Services will not be used in or for any illegal, fraudulent, unauthorized or improper manner or purpose and will only be used in compliance with all applicable laws, rules and regulations, including all applicable state, federal, and international Internet, data, telecommunications, telemarketing, "spam," and import/export laws and regulations, including the U.S. Export Administration Regulations. Without limiting the foregoing, you agree not to use the Services to transmit or disseminate any:
1. junk mail, spam, or unsolicited material to persons or entities that have not agreed to receive such material or to whom you do not otherwise have a legal right to send such material;
2. material that infringes or violates any third party's intellectual property rights, rights of publicity, privacy, or confidentiality, or the rights or legal obligations of any wireless service provider or any of its customers or subscribers;
3. material or data, that is illegal, or material or data, as determined by the Company in its sole discretion that is harassing, coercive, defamatory, libelous, abusive, threatening, obscene, or otherwise objectionable, materials that are harmful to minors or excessive in quantity, or materials the transmission of which could diminish or harm the reputation of Company or any third-party service provider involved in the provision of the Services;
4. material or data that is alcoholic beverage-related (e.g., beer, wine, or liquor), tobacco-related (e.g., cigarettes, cigars, pipes, chewing tobacco), guns or weapons-related (e.g., firearms, bullets), illegal drugs- related (e.g., marijuana, cocaine), pornographic-related (e.g., adult themes, sexual content), crime-related (e.g., organized crime, notorious characters), violence-related (e.g., violent games), death-related (e.g., funeral homes, mortuaries), hate-related (e.g. racist organizations), gambling-related (e.g., casinos, lotteries), specifically mentions any wireless carrier or copies or parodies the products or Services of any wireless carrier;
5. viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information;
6. material or information that is false, misleading, or inaccurate;
7. material that would expose the Company, any third-party service provider involved in providing the Services, or any other third party to liability; and/or
8. any signal or impulse that could cause electrical, magnetic, optical, or other technical harm to the equipment or facilities of the Company or any third party.
YOU AGREE TO COMPLY WITH THE ACCEPTABLE USE POLICY AT ALL TIMES. You agree that the Company reserves the right, but is not obligated to, monitor your use of the Services to verify compliance with the Acceptable Use Policy.
EXCLUSIONS /DISCLAIMERS OF WARRANTIES; LIABILITY LIMITATIONS; INDEMNITIES. THE SERVICE AND ALL DOCUMENTATION OR CONTENT CONTAINED THEREIN OR PROVIDED THEREWITH ARE PROVIDED "AS IS" AND "WITH ALL FAULTS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND RELATED TO THE SERVICE, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. WITHOUT LIMITING THE FOREGOING, THE COMPANY DOES NOT MAKE ANY WARRANTY OR REPRESENTATION REGARDING THE INFORMATION PROVIDED IN ALERTS, OR REGARDING THE QUALITY, RELIABILITY, TIMELINESS OR SECURITY OF THE SERVICE OR ANY ALERTS. THE COMPANY SHALL NOT BE LIABLE TO YOU OR ANY OTHER PERSON CLAIMING THROUGH YOU FOR ANY INDIRECT, CONSEQUENTIAL, OR SPECIAL DAMAGES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, THE COMPANY'S LIABILITY FOR ANY AND ALL DAMAGES, LOSSES, CAUSES OF ACTION, WHETHER IN CONTRACT, TORT OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE COMPANY, IF ANY, OR $100 DOLLARS, WHICHEVER IS LESS. YOU AGREE TO INDEMNIFY THE COMPANY FOR ALL LOSSES, DAMAGES, LIABILITIES AND COSTS INCURRED BY THE COMPANY IN CONNECTION WITH ANY CLAIM ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Security. You understand that the ability to access the Service is granted based on your possession of the configured mobile phone, and agree that if you make your mobile phone available to any other individual that you are responsible for any subsequent access of the Service and release of Card Account information. If you believe that your mobile phone has been stolen and that someone may attempt to use the Service without your consent, you must notify the Company at once by calling 1-877-883-6688 during Customer Service hours (or disable the service at www.univisiontarjeta.com at any time.)
Termination. You agree that the Company, at its sole discretion, may at any time and for any reason terminate your use of the Service or individual services provided via the Service and/or change its content offering made available through the Service. Further, you agree that the Company shall not be liable to you or any third party for any termination of your access to the Service.
Mobile Phone Number Changes. It is your sole responsibility to ensure that the phone number in your Service profile is current and accurate. Changes can be made either within the website or by contacting Customer Service. The Service is not responsible for any losses, including loss of messages, if you do not provide accurate up to date information.
Email Address Changes. It is your sole responsibility to ensure that the email address in your Service profile is current and accurate. Changes can be made either within the website or by contacting Customer Service. The Service is not responsible for any losses, including loss of messages, if you do not provide accurate up to date information.
Amendments. The Company reserves the right, in its sole discretion, to amend, change, or modify these Terms and Conditions at any time without notice, and it is your responsibility to review the Service Terms and Conditions periodically for any changes. Your continued use of the Service following any amendment will signify your acceptance of and agreement to such revised Terms and Conditions.
It will take just a couple of minutes to sign up for a Card. Enrollment is quick and easy. We do not conduct a credit or background check.
Our website secures your information so you can enroll with confidence. We use some of the most trusted security approaches in the industry. Applying on-line can actually be safer than applying by phone.
